Touchpad scrolling in vista.....not working

i bought my dv6-1054cl some 20 days ago....my touchpad dosn't scrolls on first n second touch...but after several tries it starts working...couldn't figure out whether its a driver upgrade issue or what...some1 have ne idea

Is this a new computer or a refurb?
