seagate hard drive is bad. 5 yr warranty, but seagate says i have to go through oem?

I have a Pavilion P6277C ({Personal Information Removed})that's been brought into the shop (aka my home: friend/family job). User states chkdsk runs every startup, and takes 40 minutes to log into windows if it will log in.
Pull drive, look at SMART TEST, fails big time:
Drive has a 5 yr warranty on it, but RMA on Seagate's site says I have to contact OEM for repair. Since this unit is only a one year warranty unit, how do I contact HP to get a warranty replacement on this defective drive? Or Do we enter into the "yeah it has a 5 yr warranty, but your computer is only covered for 1 yr and you're out of luck" scenario, where the end result is I buy a retail WD drive with an actual warranty?

Here are the specs for the HP Pavilion p6277c Desktop Computer. This system is over 2 1/2 years old and typically carries a one year warranty. Since the drive is an OEM unit it only carries the standard HP warranty of one year and is no longer warranted. I encountered the problem and the drive wasn't warrented by the manufacturer or HP. Best bet is to replace the bad drive with a new retail drive that carries a full warranty.

I figured that was the case. Nice of seagate to provide a warranty that's worthless for an end consumer..What's scary is the rash of bad seagate drives I've been running across lately.

I have had more issues with WD drives than Seagate but every brand appears to be making crap these days.

It's either or, at my place of employment, but the teeter totter leans towards Seagate. 9 month old Dell, seagate drive with 5 unstable sectors. Then again brand new WD, 1 unstable sector right out of the box. Heck, I had never gotten a bad set of RAM, until the last two purchases. RMA one crucial, and RMA'd two sets of Kingston HyperX..
