Defective HDD - Is it Safe to send to HP

How safe is it to send a Defective HDD  HP that has patient data (USA HIPAA Policy) . Support stated to erase the patient data. But how if the HDD is defective and there is NO magnetic equipment. Most Hospitals use :

• Destroying the hard drive through shredding, melting, or incinerating

But HP Policy states they will charge if the HDD data is erased or damaged. ????
