Brand new 60XL Black cartridge does not print

I installed a brand new 60XL black cartridge in my printer.  After it was installed, the printer continued to report that the black ink tank was low, and attempting to print produced half a page before the print faded out.  After installing a second new  cartridge, the printer works without issue.  Unfortunately, my wife threw out the packaging and receipt for the defective cartridge.  Is it still possible to have this cartridge replaced?
