after I updated from windows 8.1 to windows 10 sound will no longer go through hdmi to my tv. I tried to update the drivers it says the driver is up to date but it gives an error that
This device cannot start. (Code 10)

Here's what I recommend you try...
Since you have video through the HDMI out port, let's not mess with the actual graphics part of the driver.
Download and install this free file utility. The 2nd item on the list is for 64 bit.
After you install 7-Zip, download but do not run the W10 Intel graphics driver from your notebook's support and driver page...
This package provides the driver that enables the Intel High-Definition (HD) Graphics in supported notebook models that are running a supported operating system. If high-definition multimedia interface (HDMI) video output is supported, this package also installs the HDMI Audio Driver.
File name: sp72370.exe
After you download the above graphics driver, right click on it and select 7-Zip from the options list.
Have 7-Zip Extract to: and let it extract the driver into its folder name (sp72370).
After the file has been extracted into its driver folder, go to the device manager and click on the problem Intel HDMI audio device.
Click on the driver tab. Click on Update Driver.
Select the Browse my computer for driver software option, and browse to the driver folder that 7-Zip created.
Make sure the Include Subfolders box is checked and the driver should install.
Then restart the PC, and hopefully you will have both audio and video via the HDMI out port.
