Dear HP Support Team,

 

I am writing regarding my HP OMEN 16 laptop, which became defective after a recent software/Bios update provided by HP. After the update, the device's fans stopped functioning properly and the device is cannot be used as intended.

 

I have confirmed that many other users experienced the same issue, and according to reports, HP Poland officially recognized it as a BIOS-related defect and issued a replacement or refund for affected customers.

 

As this issue was caused by an HP software update, it falls under manufacturer liability according to EU Directive 2019/771, which requires the seller or manufacturer to repair, replace, or refund products that become defective due to software updates.

 

Therefore, I am formally requesting a full refund or a replacement device of different specification (As this issue will happen in same model, a different model must be given), as repair is not a suitable remedy for this manufacturer-induced defect.

 

Please confirm how to proceed with the replacement or refund process.
