HP Specte battery draining while off?

HP Spectre 13" touch
Microsoft Windows 10 (64-bit)
I noticed every time I go to turn on my Spectre the battery is dead. I charged it all day yesterday and just went to use it and it's at 20% battery. This seems to be an HP known issue and they are not doing anything about it.

This laptop is three months old and they are going to replace it or I'll file a claim with my corporate credit card for selling a lemon to the consumer. This is not right how they get away with this.
