Is there a way to update the C4440 that doesn't require giving HP permission to monitor usage and software interactions?

It might be possible the basic driver download from HP is not invasive, but I have not tested this theory. However, I have come to the conclusion that if I want to use the scanner to scan to my PC, my only option is third party software. Otherwise, HP offers a bundle of software that you have to give express consent to allow monitoring before installing.

Hey @Sirpdh,
I see that you are trying to install the latest drivers for your Photosmart C4440 on your Windows 10 PC without giving HP permission to monitor usage. You can do that by saying no to any screen that asks for permission.
The only screen that you can not opt out of and install the printer is the Terms of Service page.

Something must be missing from your description or there is an option on the screen that you are missing. Something along the lines of "More options", "See More", or "Select Preferences".
