ISSUE:

I own an HP OfficeJet Pro 9010 series printer, used lightly for a home office business. Until last week, it functioned well. When the cyan cartridge ran out, the printer stopped accepting black-and-white jobs despite a full black cartridge being installed. It also now “blocks” third-party replacement cartridges due to firmware updates.

 

BACKGROUND:

As a former Army officer, I have relied on HP printers for decades, both in military deployments and professional office settings. I value their quality and reliability. This new restriction, however, represents a departure from fair commercial practice. Research shows this issue is not accidental. Case law, including the Kodak precedent (1992), Doty et al. v. HP Inc. (2019), and Robinson et al. v. HP Inc. (2024), demonstrates that deliberately disabling functionality to block competition raises significant antitrust and consumer protection concerns.

 

REQUESTED REMEDY:

Please provide one of the following solutions: (1) Firmware that allows the printer to accept third-party cartridges; (2) A link to free HP cartridges for continued use; or (3) A refund for the depreciated cost of the printer. Unacceptable solutions include requiring purchase of HP-branded ink.

 

NEXT STEPS:

If HP does not address this matter, I will refer the issue to the Federal Trade Commission and the appropriate congressional committees (House Energy & Commerce; Senate Commerce, Science & Transportation) for review. HP’s use of “security” firmware updates to restrict third-party products undermines consumer choice and raises serious antitrust concerns. If HP believes these restrictions are adequately disclosed, they should be plainly displayed on the outside of all HP printer packaging, much like health warnings on food or tobacco. Absent such disclosure, there is no defensible claim to informed consumer consent.

 

CONCLUSION:

I would not have purchased this printer had I known it would be restricted from functioning with third-party materials. Please respond with one of the remedies above at your earliest convenience.
