i bought a new omen 40l pc with Amd Ryzen 7 5800X 8-core 3.80 ghz / nvidia geforce rtx 3070 Ti. Pc is hard freezing in every way , until i put nvdia settings on maximum performance it stops. What should i do?

indeed, when there is a problem with a new computer, I most often recommend returning to the seller!
But sometimes, it's as simple as that, see everything that is said, indicated, done here, and finally, drivers!
it costs nothing to try , fast ..

I am not sure what is going on. The PC is only stable when you set the 3070 Ti to maximum performance.
This action should be counterintuitive. Instability due to heat or power draw problems would usually self correct when the card is not being stressed.
I normally suggest returning a brand new PC to the seller for a refund/exchange.

You might just have a driver problem..
but under what conditions does it hang, no matter?
For me it has little effect, but if you lower the video card settings, for some tasks it can be problematic, it seems logical

You might be able to fix this but you have a new PC. It is usually easier to return/exchange or do a refund.
A freezing issue, on a new PC, is usually a heat problem or a hardware problem. It seems like the problem may be with the 3070 Ti based on your description. I don't understand why the freezing problem stops when you set the card at maximum performance. Run the card at maximum performance settings if the PC is stable this way.
Try HWiNFO portable (free version) to check component temps and power draw. https://www.hwinfo.com/download/
I would swap in a different graphics card to see if the problem goes way.
You will then have to swap in other replacement parts until you find the bad part. It could be the power supply, or the MB, or any other component connected to the MB. Symptoms don't always correlate to the cause.
