Pen acting weird

I have some odd problems with the pen that came with my HP ENVY 360.

The pen is fully charged and I can see that the screen is reacting when I holding the pen close to the screen. Like I get the hand symbol while hover over a link or when I use microsoft whiteboard I can see a dot on the screen that is following the pen. Buttons are highlighted when i hover over it.  However nothing happens when I touches the screen with the pen, no links opens or nothing is written on the whiteboard.

If I use my fingers everything works fine. I have waited a while between use my fingers and the pen so that is not the problem.

Any ideas of what is wrong?
