Hi again,
Problem with HDMI was with all Nvidia 18x.xx driver versions.
To use it without any problems install modded 179.48 version.
How to install them under Win7?
1. Download driver here (for Win7 32 bit) or here (for Win7 64 bit ) double click and select extract,
2. Download from this site with drivers also INF Modified and replace original INF in extracted folder,
3. Install & reboot.
Important information!
If You have now installed any other driver then You must uninstall it first before You will change them for others.
How to do it?
Uninstall with standard method all Nvidia graphic drivers from Your system.
Resource:
Uninstalling Software in Windows 7
Uninstall or change a program in Windows 7
Restart Your system and on boot press F8. Choose from the list ' Safe mode '.
Run Driver Sweeper (no instaler) version. Check there Nvidia Display and PhysyX.
Click on Analyze and after that on Clean.
Restart Your system again and this time run it normally.
You may now install other Nvidia driver version.

Unfortunately nothing changed after uninstalling and reinstalling the driver with modified inf.
Just to confirm, I uninstalled the driver I was using through the programs uninstall.
I restarted the computer - A standard VGA driver was installed automatically
I installed the new 179.xx driver with modified inf
Restarted
Set audio to SPDIF
and attached to HDMI
Video works fine, but no audio

As a FYI problem was solved. I had to install the oldest drivers listed on the official HP webpage. There was a newer driver from 4/09 posted by HP for use with the dv9207us, so I assumed that should work. When that did not work I assumed the older driver from 1/08 would not work either.
Never assumed as installed the 1/08 drivers restored HDMI audio in windows 7. No modified inf needed, simply run setup and it will install as vista 32 drivers.

@mahyar
Install Nvidia Chipset HERE next go to Control Panel and run Windows Update, choose to also see Optional updates. You should get audio, modem and Nvidia graphics driver at the very least. You may have to reboot and run WU a couple of times.
You will probably still need these>>
Ricoh Card Reader Driver (32-bit and 64-bit), sp37614
HP Quick Launch Button software (32-bit and 64-bit), sp46731
