So I was thinking of upgrading from a i5 10400f to an i710700f on my hp 8767
But then I noticed that the i7 has a 65w tdp but can draw more power on pl2 settings around 140w
Now I know the motherboard doesnt have those settings so how does the motherboard work with this
Does it keep the cpu running at 140w or does it keep it at 65w and only boosts it to 140w later on and does it maintain that boost under stress or does it download after a certain period of time

Amongst the Baker motherboard (SSID: 8767) HP Pavilion Gaming Desktop TG01-1xxx performance results, here is one fitted with an i7-10700K: https://www.userbenchmark.com/UserRun/47804659. The higher-wattage (95-watt) Intel Core 10th gen "K" processors are indeed compatible with your PC.
This "K" processor has a nominal 95-watt TDP, up to a potential 125-watt TDP.
As @BeemerBiker mentioned, your PC is likely fitted with the 95-watt rated "Kidd" CPU heatsink. I believe this heatsink may be sufficient to cool a "K" processor if the overall airflow through your case is improved -meaning, adding one or more case cooling fan(s).
You could also consider upgrading your CPU heatsink, as this YouTube video shows: HP Pavilion TG01 Cooling Upgrade Noctua CPU Heat sink and Fan Install W/ How To 1.

I looked up your TG01-1000nx here where the parts list is shown. The exact parts list can be better found by entering your serial number instead of the model number.
The heat sink on the CPU is rated at

The i7 will probably overheat
the power supply is 310 watts

I recommend you upgrade the GPU and the power supply. Your 1000nx is not listed here, but I suspect the larger power supplies will work.
The RTX-4060 requires a minimum of 300 watts according to TechPowerUP
possibly that will work but possibly our upgrade expert @NonSequitur777 can provide better advice.

Thank you for replying, I have actually upgraded my psu to a 500w power supply
Currently im using the rtx 5050
Im asking about the wattage of the cpu as im not sure whether the stock cooler would suffice or i may need to buy another one
Also if I do buy another cpu cooler would I be able to control its speed as the current one has no option for this
