The computer is brand new out of the box, so one would assume the batteries full charge capacity would be 100%? or is this achieved by using the laptop/letting it die and recharging it a few times? or am I wrong in thinking something is wrong and this 94% is put in place to protect the battery?

Yes, it is designed that way to avoid overcharging the battery and to extend the life of the battery.
