my hp laptop 17-by1033DX has a swollen battery but its not on the list of recall. i already purchase a new unit and swap it out. what is HP doing about this and what can i do to prevent it ?

Have you read the HP official document at the hyperlink below this line?
Download the fully loaded battery validation utility from the link in the document and run it to see if your notebook's battery is on the recall list.

i found that link after i swapped the battery already. i opened a case with hp they asked for a picture of the battery but have not found out anything yet. but the windows update for the battery does not apply to my laptop. so what can we do to prevent from this happening again? or was this just a bad design of batteries ?

The replacement campaign does not, as far as I am aware have anything to do with a Windows update.
Can you provide the case number? I can ask a Moderator to connect you with an appropriate team within HP to help you with finding out what the resolution of the issue is. The greatest likelihood is that it is a battery manufacturing issue, as in bad batches of batteries. There is nothing that we, as consumers, can do to prevent this from happening.
It isn't a bad design issue. Currently lithium Ion batteries are state of the art for notebook PCs.

I see you are experiencing issues with the HP Laptop 17 has a swollen battery.
HP expanded its ongoing worldwide voluntary safety recall and replacement program for certain notebook computer and mobile workstation batteries. I have checked and this model is not on the recall program. So It is a hardware issue on the battery.
As we have limited support boundaries in the support community as of now. I would request you to contact our HP Support Engineers and should be able to sort this out. Hence I encourage you to contact HP support for out of warranty service options.
Please reach out to the HP Technical Support team in your region regarding the service/replacement options.
Follow the instructions below to reach them:
1) Click on this link - https://support.hp.com/us-en/contact-hp
2) Select your product type below.
3) Enter the serial of your device.
4) Select the country from the drop-down.
5) Select the chat or get phone number options based on your preferences.
6) Fill the web form and proceed further.
