found the answer.
I noted that windows update had the Synaptics Touchpad in the optional updates. I know I installed the latest, so went to look and noted that the mouse was listed as HID compliant mouse vs touch pad. I reinstalled the touchpad driver and the unknown driver went away. I'm not sure exactly what the device is as the device ID does not match the touchpad driver.

Copied and pasted straight fromt the properties menu:
USB\VID_1242&PID_4058&REV_0072
USB\VID_1242&PID_4058
Nothing plugged in other than a netwok cable and power. No internal additions or upgrades. Fresh install of Win 7 32 Bit. All other drivers accounted for.
