Why has my brand new laptop got old files on it

I was just wondering if anyone knows why my supposedly brand new latop would have files more than a year old on it...

I also downloaded all of my photos from my phone onto my laptop and they have disappeared, along with most of the apps on my desktop.
Not to be too paranoid but have they sold me a used laptop or am i being paranoid?

It's a valid question but you've given us no information to work with.  What are the filenames?  Where were they located?

Without any details, we can't help you.
