If it is new, it'll have definitely if it HP genuine battery.

Other than this I don't have any other suggestions to offer you.

ok one last question will it work if i replace the failed battery with new one or if i remove the failed battery

You've to see. Well if it didn't work now, then it ought to work with another branded genuine HP battery.
