In July I upgraded from a RTX 4060 to an RTX 5070, and kept having the drivers crash on boot, I returned it but now I'm wondering if hp had updated there bios for their FrostBreath motherboards for 50 series support as i'm interested in upgrading?

There are many similar complaints from HP users, especially Omen and Pavilion desktops, where the latest Nvidia RTX 50xx and AMD RX 90xx series graphics cards either not work or show functionality issues. What has also been shown is that some RTX 50xx brands such as Asus and MSI fare better than other brands.
Here is an OMEN by HP 40L Gaming Desktop GT21-1xxx as fitted with the ArcticU motherboard (SSID: 8A97) with an Asus RTX 5090: https://support.hp.com/us-en/document/ish_7339679-7339723-16.
I am not sure about the GT21-1xxx models fitted with the FrostBreath motherboard (SSID: 8A98) like yours -there are no Userbenchmark users with an RTX 50xx series graphics card.
Make sure you got the latest BIOS version (F.18 Rev.A) which you can find here: OMEN 40L Desktop GT21-1304 Bundle PC (8R3T0AA) Software and Driver Downloads | HP® Support.
The underlying issue is outdated HP microcode/BIOS, and until HP fixes this, issues like yours will unfortunately continue. I also tried to make an RTX 5070 work in an HP Pavilion TP01-3xxx upgrade project but couldn't -trust me, I definitely share your frustration.
