Hey everyone, I tried HPs suggestions here, anyway, to fix it this worked for me.
Go to the driver download page for the device (i did this on Windows 10), select and download the firmware. Make sure the device connected to the same network as your download download device. Run the package, assuming it finds the printer on your network, it will install the update. Mine now reporting "your printer now on the latest update".
Directly installing from the printer and using HP Smart does not work, so I'll save you the time.

Tried all that. Once completed printer reported that it was not connected to Instant Ink and the cartridges could not be used. Had to reset prinetr to default and restart everything. Now its connected to instant ink but the download firmware problem has returned. HP Smart cannot find any fault and the download assistant cannot find the printer. Tried downloading the updated formware tp my laptop, which then searches for the printer. It finds the correct printer but will not allow it to be selected for teh update to install.
COME ON HP what are you playing at?!!!!!!!!

Finally I have found the solution.
Download and install the HP software assistant.
This showed 3 updates waiting including an HP solutions (for IT professionals). I allowed all updates and about 20mins later the printer reported working with the latest firmware.
Beware some update windows are behind 'waiting' ones
