Victus by HP 16.1 inch Gaming Laptop PC 16-r0000 (76T05AV)
To HP Canada Customer Support,

I am writing to formally raise a hardware defect with my HP Victus 16 laptop (Model: 16-r0028ca (7Q9Z7UA)
, purchased in July 2023.

My laptop has developed symptoms consistent with a widely reported Hall Effect sensor failure:  As per tech: Our technician's findings indicate that the unit was originally received with a defective motherboard. The device showed charging activity but would not power on.  . A diagnosis from [an HP-authorized service center / an independent technician] confirmed this is a Hall sensor failure that has caused damage to the motherboard.

I want to be clear that this is not an isolated incident. This is a well-documented, recurring issue across the Victus 16 series (16-s0xxx, 16-r0xxx, and related models), reported by numerous customers on HP's own Support Community forum. For example:

1. https://h30434.www3.hp.com/t5/Gaming-Notebooks/HP-VICTUS-MOTHERBOARD-DESIGN-FLAW/td-p/9355675 - a user describing this as a well-known motherboard design flaw that HP has declined to acknowledge, despite an open case for nearly two months.

2. https://h30434.www3.hp.com/t5/Notebook-Software-and-How-To-Questions/Hall-Sensor-Issues-in-HP-Victus... - explaining that most Victus 16 series units (S0xxx, S1xxx, R0xxx, R1xxx) share this issue due to sensor placement near the heat source, with no official statement from HP.

3. https://h30434.www3.hp.com/t5/Gaming-Notebooks/HP-Victus-16-Hall-Sensor-Defect/td-p/9601103 - a customer raising the same argument I am making here: that a recurring, documented defect should be treated as production-related regardless of warranty status.

4. https://www.badcaps.net/forum/troubleshooting-hardware-devices-and-electronics-theory/troubleshootin... - an independent repair technician's teardown finding that the specific sensor part (TCS40DLR) fails after only months of use at elevated temperatures, and may have been run below its rated minimum voltage from the factory.

Under British Columbia's Sale of Goods Act, there is an implied condition that goods must be durable for a reasonable period of time, having regard to normal use and the circumstances of the sale. This protection exists independently of the manufacturer's written warranty period and cannot be waived by a retailer or manufacturer. Given that this defect is heat-induced, recurring, and affects a documented population of Victus 16 units rather than resulting from misuse, I believe it falls squarely within this protection.

Thank you for your reply. I've tried to reach out to the HP support team, but in vain, since my warranty is outdated. The AI assistant couldn't help at all and only kept pushing me to buy a service from HP. But I feel this is HP's product problem, not mine — that's why I'm raising it here, as I have no other way to get my issue heard by them. It's made me quite frustrated.
